These Terms of Service govern your access to and use of the 300Photo's website ("Website") and service ("Service"). This will constitute a binding agreement between you and 300Photo. Your access to and use of the Service are expressly conditioned on your compliance with these Terms of Service. Note that any violation of these Terms of Service may result in termination of our Service to you.
300Photo reserves the right to change these Terms of Service from time to time. Please refer to this web page periodically for any changes. By continuing to access or use the Service after 300Photo makes any such changes, you agree to be bound by any such revised Terms of Service.
We undertake to provide our Services according to the images and instructions submitted by registered customers. If the submission is successfully accepted by us, we will start working and deliver the edited images to the customer within a limited time frame as described in the order summary before the order is placed.
Under these Terms of Service, you agree that you will NOT post, place or transmit any of the following material or obtain any such material using the Service:
- Any threatening, defamatory, abusive or inappropriate material or any material that could give rise to any civil or criminal liability under applicable law
- Any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons (or their parents or legal guardians, where applicable) who are shown in the material if applicable
- Any material sent from an anonymous or false address
- Any material that promotes bigotry, racism, hatred or harm against any individual or group
- Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
The images you sent to us and the derivative retouched/edited images from your submission are not accessible to the public, unless you have explicit consent to grant us your permission to publish your images to our online portfolio or in promotional materials.
You may contact us to delete the images that you have submitted to us at any time. When the images are deleted from your account, they will no longer be accessible to you or others who may access your account, but there may continue to be residual copies due to the nature of the computer system's operation and ongoing data back-up and archiving.
We use third-party payment processors ("Payment Processors") to process your payment for use of the paid services. The processing of payments may be subject to the terms, conditions and privacy policies of the Payment Processors in addition to this Terms of Service. We are not responsible for any error caused by the Payment Processors. By choosing to use paid services, you agree to pay us, through the Payment Processors, all charges at the prices then in effect for any use of such paid services.
Revision requests are time-bound. We provide free revision requests within 14 days from the date of order delivery. When the order is approved or automatically closed, you are still able to request a free revision within 14 days from the date of approval.
The original version of the images you submitted and the derivative retouched/edited images from your submission are kept on our servers only for 30 days. You are responsible for downloading them in time.
You may end your business with 300Photo at any time.
300Photo reserves the right in its sole discretion to refuse, suspend, or terminate Service to anyone for any reason, with notice.
As this Terms of Service may be updated from time to time. You should periodically review it to keep abreast of our plans and procedures. Your continued use of the Website and Services constitutes your agreement to this Terms of Service and any updates. Any violation of these provisions may result in termination of your use of service.
